1. Who we are

These Terms govern your use of "42 — The Distance Game" (the "Service"), operated by R&D STREAMS ("we", "us", "our"). By using the Service you are entering a binding agreement with R&D STREAMS.

2. Acceptance

By creating an account or otherwise continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. You must be of legal age in your jurisdiction or have appropriate authority to enter this agreement.

3. The Service

The Service is an online multiplayer guessing game. We may modify, suspend, or discontinue features at any time. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

4. Account & credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.

5. Acceptable use

You agree not to:

• use the Service for any unlawful purpose, fraud, or spam;
• infringe the intellectual property or other rights of any party;
• interfere with or attempt to compromise the security of the Service (including via malware, probing, scraping, or reverse engineering);
• resell, redistribute, or circumvent technical limits of the Service.

6. Intellectual property

The Service, including its software, design, branding, and content (excluding user content), is owned by R&D STREAMS and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.

7. Payments and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms in addition to our Refund Policy.

Custom room credits are sold as one-time purchases at the price displayed at checkout. Once a credit is consumed to unlock a custom room, it is considered used.

8. Suspension and termination

We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious violations of our policies. You may stop using the Service at any time.

9. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising from or related to the Service is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after the changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which R&D STREAMS is established, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer protection law provides otherwise.
